TROY LONION, Appellant v. TRAVIS BAUCOM, Appellee

On Appeal from the 192nd Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-14-11293

ORDER

Before the Court is appellant's April 6, 2017 motion for extension of time to file a notice of appeal. We GRANT appellant's motion. The notice of appeal filed on March 3, 2017 is deemed timely for jurisdictional purposes.

The reporter's record is overdue. The court reporter informed this court that appellant had neither requested nor paid for the reporter's record. By letter dated March 22, 2017, the Court instructed appellant to provide, within ten days, notice that he has requested preparation of the reporter's record and written verification that he has either paid or made arrangements to pay the reporter's fee or written documentation that he has been found to be entitled to proceed without payment of costs. We cautioned appellant that failure to file the required documentation within the time specified may result in an order to submit the appeal without the reporter's record. As of today's date, appellant has not filed a response. Accordingly, we ORDER the appeal be submitted without the reporter's record. See TEX. R. APP. P. 37.3(c).

Appellant's brief is due within thirty days of the date of this order.
