On October 25, 2021, respondent filed a Declaration of Karen Carreiro-Smithson in Support of Memorandum in Support of Motion for Partial Summary Judgment. A second Declaration of Karen Carreiro-Smithson in Suport of Respondent's Motion for Partial Summary Judgment was filed. It appears that the only difference in the two Declaration is the title of the cover sheet. Respondent's counsel called the Court on or about October 25, 2021 and stated that the second Declaration is the correct title.
Upon due consideration, it is
ORDERED that respondent's Declaration of Karen Carreiro-Smithson in Support of Memorandum in Support of Motion for Partial Summary Judgment (Index # 0049), is hereby deemed stricken from the Court's record in this case.
