Appellee has filed a motion to dismiss this appeal based on mootness. On April 2, 2024, we informed the parties by letter that the motion was deferred to the submissions panel and directed appellee to file his response to appellants' merits brief no later than May 2, 2024.

Before the Court is appellee's motion to have the dismissal motion set for hearing and the brief deadline postponed until after the hearing. We note appellee has filed his brief. Accordingly, we DENY the motion as moot.

The appeal will be submitted in due course.
