Long v. State

District Court of Appeal of Florida, Second District
Jul 2, 1975
314 So. 2d 818 (Fla. Dist. Ct. App. 1975)

Opinion

Nos. 74-993, 74-994.

July 2, 1975.

Appeals from Circuit Court, Polk County; William K. Love, Judge.

James A. Gardner, Public Defender, Sarasota, and Harold H. Moore, Asst. Public Defender, Bradenton, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and William I. Munsey, Jr., Asst. Atty. Gen., Tampa, for appellee.

The judgments are affirmed. However, the record reflects considerable confusion over the sentence which the court intended to impose in Case No 74-994 (lower court Case No. CF 74-60). Accordingly, Case No. 74-994 is remanded with the request that the trial judge clarify the term of the sentence he intended to impose.

HOBSON, A.C.J., and GRIMES and SCHEB, JJ., concur.
