Rose Ann LOERA, Appellant v. The STATE of Texas, Appellee

From the 187th Judicial District Court, Bexar County, Texas

Trial Court No. 2004CR3589

Honorable Raymond Angelini, Judge Presiding

ORDER

This appeal is set for submission on October 8, 2013. The motion to withdraw filed by appellant's counsel is GRANTED. Since appellant is indigent, new appellate counsel must be appointed exclusively for purposes of taking whatever actions may be appropriate after this court's opinion issues. It is therefore ORDERED that the trial court appoint new appellate counsel for the limited purpose stated in this order and to cause the trial court clerk to file a supplemental clerk's record containing documentation of such appointment within two weeks from the date this order is signed. See Duncan v. State, 653 S.W.2d 38, 40 (Tex. Crim. App. 1983) (holding that appellate courts may abate appeals so that trial court can assure appellant has effective assistance of counsel).

Catherine Stone, Chief Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 13th day of September, 2013.
