ORDER

Kathleen Kerrigan Chief Judge.

On August 26, 2023, respondent filed in the above-docketed matter a Motion To Dismiss for Lack of Jurisdiction. By Order served August 30, 2023, petitioner was directed to file an objection, in any, to respondent's motion. When it appeared that no response from petitioner had been received, an Order of Dismissal for Lack of Jurisdiction was entered on October 18, 2023. However, it has since come to the Court's attention that an objection from petitioner had been received on October 10, 2023, but had crossed with the dismissal in mail processing procedures.

Accordingly, to allow the Court more fully to respond to petitioner's objection, it is

ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction, entered October 18, 2023, is hereby vacated and set aside.
