On order of the Court, the application for leave to appeal from the April 18, 2000 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals and REINSTATE the judgment of the Oakland Circuit Court for the reasons stated in the dissenting Court of Appeals opinion. We REMAND the case to the Court of Appeals for consideration of the other issues raised by the plaintiff but not addressed by the Court of Appeals.

Cavanagh and Kelly, JJ., would deny leave to appeal.
