Opinion
Gen. No. 43,165. (Abstract of Decision.)
Opinion filed February 6, 1945 Released for publication February 20, 1945
AUTOMOBILES AND MOTOR VEHICLES, § 241 — when judgment for plaintiff in action for death of passenger in automobile, struck by street car, will be affirmed. On review of judgment for plaintiff on jury's verdict in action for wrongful death, occurring after automobile in which deceased was riding was struck by defendants' street car and one of kidneys of deceased allegedly was thereby misplaced, held that Appellate Court would not be warranted in disturbing verdict on ground that it was against manifest weight of evidence, and, further, that giving of instruction, complained of by defendants, was not reversible error even if it was ruled that instruction was technically inaccurate.
