  1. Claassen v. Heckler

    600 F. Supp. 1507 (D. Kan. 1985)   Cited 49 times

The courts have always given great weight to the ALJ's findings where credibility of witnesses is concerned. Where the ALJ does not fully believe Plaintiff's subjective testimony, however, he is required to make specific findings and state his reasons for disbelieving evidence or testimony supporting his belief. Marcus v. Califano, 615 F.2d 23 (2d Cir. 1979); Scharlow v. Schweiker, 655 F.2d 645 (5th Cir. 1981); Beavers v. Secretary of Health, Ed. Welfare, 577 F.2d 383 (6th Cir. 1978); Broadbent v. Harris, supra; and Little v. Schweiker, 555 F. Supp. 541 (N.D.Tex. 1982). The ALJ in this case made no findings of credibility adverse to Plaintiff.
