On order of the Court, the application for leave to appeal from the April 19, 2002 decision of the Court of Appeals and the motion for leave to file a brief amicus curiae are considered and GRANTED.

We further ORDER that this case be argued and submitted to the Court together with the case of Martin v Redmond (Docket No. 120932), at such future session of the Court as both cases are ready for submission.
