JAMES M. LINN, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Emin Toro Judge

This case was calendared for trial during the Court's January 30, 2023, Kansas City, Missouri, trial session. On January 12, 2023, petitioner filed a Motion for Continuance of Trial (Doc. 9) in part to permit the parties to locate documents previously provided to respondent. By Order served January 24, 2023, among other things, petitioner's Motion for Continuance of Trial was granted, and the undersigned judge retained jurisdiction.

On January 31, 2024, respondent filed a Status Report (Doc. 19) informing the Court that:

2. On January 29, 2024, Respondent's counsel discussed the status of the administrative file request with a program manager in respondent's document retention department.
3. Respondent's counsel was advised that although progress has been made, a significant backlog remains in "shelving" files so that they can be retrieved. IRS employees are working hard to eliminate this backlog. However, the administrative file for this matter still has not been shelved.

Upon due consideration, it is hereby

ORDERED that, on or before April 1, 2024, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document.
