In an action to recover treble damages for unlawful and willful injury to plaintiff's boat, sustained when defendant caused his boat to run into and ram plaintiff's boat, in the bay of New York (Penal Law, § 1433, subd. 3), judgment in favor of plaintiff and against defendant unanimously affirmed, with costs. Order settling the record on appeal so as to include therein certain stipulations, unanimously affirmed, without costs. No opinion.
