Lindor v. State

District Court of Appeal of Florida, Fourth District
Jul 13, 1988
527 So. 2d 972 (Fla. Dist. Ct. App. 1988)

Opinion

No. 87-2845.

July 13, 1988.

Appeal from the Circuit Court for Palm Beach County; Harold J. Cohen, Judge.

Richard L. Jorandby, Public Defender, Ellen Morris, Asst. Public Defender, and Mathew Blust, Certified Legal Intern, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Carolyn V. McCann, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm appellant's conviction and sentence, but reverse as to the imposition of costs. The State concedes that the assessment of costs on the judgment was erroneous.

AFFIRMED IN PART; REVERSED IN PART; AND REMANDED.

GUNTHER and STONE, JJ., and TOBIN, DAVID L., Associate Judge, concur.
