S. EMANUEL LIN, Appellant v. ESTATE OF KENNETH JAMES WILCHENSKI, ROBERT FLOYD SUE TRUCKING, INC., Appellee

On Appeal from the 269th District Court Harris County, Texas Trial Court Cause No. 2016-62142

Panel Consists of Christopher Chief Justice and Wise and Hassan Justices.

ORDER

PER CURIAM

Appellant's brief was originally due July 20, 2023. On January 23, 2024 we abated this appeal and directed the trial court to settle a dispute regarding the reporter's record. On September 24, 2024, we reinstated the appeal and set appellant's brief due 30 days from the order. Prior to the January 23, 2024 abatement order we granted two extensions of time to file appellant's brief. After the September 24, 2024 reinstatement order we granted appellant's motion for extension of time to file appellant's brief until December 5, 2024. When we granted the final extension, we noted that no further extensions would be granted absent exceptional circumstances. On December 4, 2024, appellant filed a further request for extension of time seeking an additional 60 days to file appellant's brief. We deny the request and issue the following order.

We order appellant to file a brief with the clerk of this court on or before January 9, 2025. If appellant does not timely file the brief as ordered, the court will dismiss the appeal for want of prosecution. See Tex. R. App. P. 42.3(b).
