No. SC2024-1209 (Fla. Aug. 29, 2024)

Opinion

SC2024-1209

08-29-2024

Tyrone Brett Lightsey, Petitioner(s) v. State of Florida, Respondent(s)

Lower Tribunal No(s).: 4D2024-1532; 062002CF020733C88810

To the extent Petitioner seeks to invoke the Court's all writs jurisdiction, the petition is hereby dismissed for lack of jurisdiction because Petitioner has failed to cite an independent basis that would allow the Court to exercise its all writs authority and no such basis is apparent on the face of the petition. See Williams v. State, 913 So.2d 541, 543-44 (Fla. 2005); St. Paul Title Ins. Corp. v. Davis, 392 So.2d 1304, 1305 (Fla. 1980). To the extent Petitioner seeks a writ of mandamus, the petition is hereby denied because Petitioner has failed to show a clear legal right to the relief requested. See Huffman v. State, 813 So.2d 10, 11 (Fla. 2000). No motion for rehearing will be considered by this Court.

CANADY, LABARGA, GROSSHANS, FRANCIS, and SASSO, JJ., concur.
