DECISION AND ORDER ON MOTION

Motion to consolidate.

Cross motion to dismiss appeals.

Cross motion to dismiss appeals or to strike memorandum of law dated November 1, 2012.

Upon the papers filed in support of the motion and the cross motions and the papers filed in opposition to the cross motions to dismiss, it is

ORDERED that the motion to consolidate is granted, without costs, to the extent that the appeals shall be heard together and may be perfected upon a joint record on appeal and brief, and it is further

ORDERED that the cross motions to dismiss are denied, without costs, and without prejudice to the issues involved being raised upon the argument of the appeals, and it is further

ORDERED that the cross motion to strike the memorandum of law dated November 1, 2012 is granted, without costs, to the extent that the memorandum of law and all references thereto in the appellant's brief are hereby deemed stricken, and appellant shall file and serve a corrected record on appeal and brief on or before July 5, 2013.
