Miguel Angel Licona-Ortega, Petitioner v. The People of the State of Colorado, Respondent

Court of Appeals Case No. 19CA11

Petition for Writ of Certiorari DENIED.

JUSTICE MARQUEZ would grant as to the following issues:

Whether the division erred in holding that "exigent circumstances" supported the warrantless search of the defendant's real-time cell phone location.

Whether Flowers v. Mississippi, 139 S.Ct. 2228, 2249 (2019)-which allows courts to compare general similarities between prospective jurors for purposes of a Batson analysis-impliedly overruled this court's contrary suggestion in People v. Beauvais, 2017 CO 34, paragraph 56, 393 P.3d 509, 524, such that the division erred in following Beauvais to affirm the trial court's Batson ruling in this case.
