Pending in the above-docketed matter is a Motion To Shift the Burden of Proof, filed December 13, 2023, by petitioner herein. Subsequently, on December 22, 2023, petitioner filed two documents, designated as a Second Supplement to Motion To Shift the Burden of Proof and a Third Supplement to Motion To Shift the Burden of Proof, respectively. Review shows that the submissions are identical, seeking to correct scrivener's errors, except that only the latter is signed.

Accordingly, the premises considered, it is

ORDERED that the document filed December 22, 2023, at Docket Index No. 11 shall be deemed stricken from the Court's record in this case. It is further

ORDERED that the document filed December 22, 2023, at Docket Index No. 12 shall be recharacterized as a First Amendment to Motion To Shift the Burden of Proof.
