609 So. 2d 781 (Fla. Dist. Ct. App. 1992)

Opinion

No. 92-0577.

December 30, 1992.

Appeal from the Circuit Court for Broward County; Stanton S. Kaplan, Judge.

Richard L. Jorandby, Public Defender, and Robert Friedman, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Sarah B. Mayer, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm the conviction. As to the public defender's fees, however, we reverse the assessment because of the absence of prior notice to the defendant. See In the Interest of R.B., 582 So.2d 163 (Fla. 4th DCA 1991).

POLEN and FARMER, JJ., and DOWNEY, JAMES C., Senior Judge, concur.
