Dear Counsel:

Plaintiff has moved to tax costs in the amount of $1,405.00 in this case in which the plaintiff recovered a verdict of $8,700.00 for PIP benefits. Plaintiff moves to tax court costs in the amount of $405.00 and an expert witness fee in the amount of $1000.00. Court costs appear to be $255.00 and will be allowed in that amount.

The expert witness was also the treating physician who was owed the claim in which the lawsuit was based. He is obviously also the beneficiary of the award. In it's discretion the Court will allow $500.00 as an expert witness fee.

Plaintiff has also moved for pre-judgment interest but as this claim was not made in the complaint it will be disallowed.

IT IS SO ORDERED.
