MEMORANDUM OPINION


A review of this appeal shows appellant filed the notice of appeal on July 18, 2005. In letters dated July 19, 2005, we informed appellant that the $125 filing fee and the docketing statement were overdue. We instructed appellant to file the docketing statement and pay the $125 filing fee within ten days, or by July 29, 2005. We cautioned appellant that the appeal would be dismissed if appellant failed to file the docketing statement and pay the filing fee. To date, appellant has not responded.

On August 24, 2005, the county clerk copied the Court on a letter directed to appellant. The letter stated that the clerk's record had been prepared and was ready to file. The letter instructed appellant to pay the $21 fee and informed appellant that the clerk would deliver the record to this Court once the fee had been received. To date, the record has not been filed.

Accordingly, we DISMISS this appeal for want of prosecution. See Appendix to the Tex.R.App.P. B(1)(a); Tex.R.App.P. 5, 37.3(b), 42.3.
