The attorneys for appellee have filed a motion to dismiss the appeal in the above styled cause and the Court having heard argument of counsel for the respective parties, it is, upon consideration,
Ordered that the said motion to dismiss be and the same is hereby granted and the appeal in said cause commenced by notice of appeal filed in the Circuit Court for Polk County, Florida, on September 21, 1959, be and the same is hereby dismissed.
