Motion to dismiss appeal as moot and remit for further proceedings or, in the alternative, for extension of time to file and serve respondent's brief.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion to dismiss the appeal as moot and remit for further proceedings is denied, without costs, and without prejudice to the issue involved being raised on the argument of the appeal, and it is further

ORDERED that the motion for an extension of time to file and serve respondent's brief is granted, without costs, and the time is extended to February 28, 2022.
