ORDER DISMISSING ACTION


By order filed February 18, 2003, the Court dismissed plaintiffs complaint and denied without prejudice plaintiffs application to proceedin forma pauperis. The Court afforded plaintiff the opportunity to file an amended complaint within 30 days of the date of the order. To date, plaintiff has not filed an amended complaint.

Accordingly, the above-entitled action is hereby DISMISSED.

The Clerk shall close the file.

IT IS SO ORDERED.
