ORDERED

1. The individual defendants' motions to dismiss counts I, II, III, and IV are granted;

2. The motion of the Board of Education of Kent County to dismiss counts I, and II is denied; and

3. The motion of the Board of Education of Kent County to dismiss counts III and IV is granted.
