Lewin v. County of Suffolk

Appellate Division of the Supreme Court of New York, Second Department
Apr 1, 2002
293 A.D.2d 453 (N.Y. App. Div. 2002)

Opinion

2001-07026

Submitted February 20, 2002.

April 1, 2002.

In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Suffolk County (Catterson, J.), dated June 13, 2001, which granted the defendant's motion for a pretrial hearing to determine the admissibility of the testimony of the plaintiffs' expert witnesses.

Ginsberg Broome, P.C., New York, N.Y. (Robert M. Ginsberg of counsel), for appellants.

Robert J. Cimino, County Attorney, Hauppauge, N.Y. (John D. Aspland of counsel), for respondent.

Before: DAVID S. RITTER, J.P., SANDRA J. FEUERSTEIN, CORNELIUS J. O'BRIEN, HOWARD MILLER, SANDRA L. TOWNES, JJ.

ORDERED that the appeal is dismissed, with costs.

It is well settled that no appeal lies from an order adjudicating in advance of trial the admissibility of evidence (see CPLR 5701; Menis v. Raksin, 154 A.D.2d 357; Pellegrino v. New York City Tr. Auth., 141 A.D.2d 709; Cotgreave v. Public Administrator of Imperial County [Cal.], 91 A.D.2d 600). The Supreme Court's order is, in effect, such an order.

RITTER, J.P., FEUERSTEIN, O'BRIEN, H. MILLER and TOWNES, JJ., concur.
