Melanie LEVY and Alan Levy, Appellants v. WEINRITTER ST. PAUL SQUARE, LLC, Appellee

From the 408th Judicial District Court, Bexar County, Texas Trial Court No. 2021CI19896 Honorable Nicole Garza, Judge Presiding

ORDER

Luz Elena D. Chapa, Justice

On October 4, 2024, attorneys C. Birk Hutchens and Fred Johnson of Spencer Fane LLP filed a motion to withdraw as counsel for appellants Melanie Levy and Alan Levy. Appellee filed a response stating they did not oppose the motion. The motion satisfies the requirements of Texas Rule of Appellate Procedure 6.5. See Tex. R. App. P. 6.5(a), (b). Although the motion states counsel served appellants with a copy of the motion and informed them of their right to object, and that appellants do not consent, appellants have not objected or otherwise responded to the motion.

Accordingly, we grant the motion and order attorneys C. Birk Hutchens and Fred Johnson of Spencer Fane LLP withdrawn as counsel for appellants. Hutchens and Johnson are ordered to immediately notify appellants, in writing, of any deadlines or settings that the attorneys know about at the time of withdrawal but that were not previously disclosed to the party. The withdrawing attorneys must file a copy of that notice with this court's clerk.
