It is Ordered that the defendant-appellant's motion seeking to enlarge the time to perfect the appeal is granted on condition that defendant-appellant perfects his appeal by no later than the November 2016 term - the filing deadline for which is September 13, 2016. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move on five days' notice, for an order dismissing the appeal.
