Levine v. Lozea

Appellate Division of the Supreme Court of New York, First Department
Feb 13, 1951
278 App. Div. 636 (N.Y. App. Div. 1951)

Opinion

February 13, 1951.

Present — Peck, P.J., Cohn, Callahan, Van Voorhis and Shientag, JJ.

A review of all the evidence, particularly the writings, leads us to conclude that the finding of the jury to the effect that plaintiffs had brought about a meeting of the minds between the purchaser and the seller on all essential terms of the transaction is contrary to the weight of the credible evidence. Judgment unanimously reversed and a new trial ordered, with costs to the appellant to abide the event.
