Court of Appeals of Texas, Fifth District, Dallas
Feb 12, 2004
No. 05-04-00141-CV (Tex. App. Feb. 12, 2004)

Opinion

No. 05-04-00141-CV.

Opinion issued February 12, 2004.

On Appeal from the 254th Judicial District Court Dallas County, Texas Trial Court Cause No. 02-12927.

Dismissed.

Before Justices WHITTINGTON, LANG, and LANG-MIERS.

MEMORANDUM OPINION

Appellant filed a notice of appeal complaining of the trial court's "interlocutory discovery ruling denying her motion to exclude the testimony of" a witness and the trial court's refusal to hear appellant's motion for attorney's fees. Appellant also filed a motion to stay trial set to begin on February 9, 2004. The Court directed appellant to file a letter brief explaining how the Court has jurisdiction over the interlocutory orders. After reviewing appellant's response, the Court concludes it does not have jurisdiction over this appeal. See Tex. Civ. Prac. Rem. Code Ann. § 51.014 (Vernon Supp. 2004); Tex. Gov't Code Ann. § 22.221 (Vernon Supp. 2004). Accordingly, the Court DISMISSES this appeal for lack of jurisdiction. Tex.R.App.P. 42.3.
