Levenson v. Market Foods Distributors

Supreme Court of Florida
Nov 5, 1981
405 So. 2d 974 (Fla. 1981)

Opinion

No. 59427.

November 5, 1981.

Application for Review of the Decision of the District Court of Appeal — Direct Conflict of Decisions, First District — Case No. QQ-150.

Stephen Marc Slepin of Slepin, Slepin Lambert, Tallahassee, and Albert E. Harum, Jr., Coral Gables, for petitioner.

H. George Kagan of Miller, Hodges Kagan, Miami, for respondent.

We initially granted the instant petition for review on the basis of conflict with Southern Bell Telephone Telegraph Co. v. McCook, 355 So.2d 1166 (Fla. 1977). After argument, we have concluded that no conflict exists and that the Court is therefore without jurisdiction. The petition for review is denied.

It is so ordered.

SUNDBERG, C.J., and ADKINS, BOYD, OVERTON, ALDERMAN and McDONALD, JJ., concur.
