Ross Levay v. Bay Animal Hospital
LC No. 21-003585-NM
Brock A. Swartzle Presiding Judge Stephen L. Borrello Michael F. Gadola Judges
ORDER
The motion to seal record on applications and orders for waiver of fee prepayment is GRANTED TO THE EXTENT that appellant's motion to waive fees filed on February 25, 2022 and motion for reconsideration filed on April 5, 2022, including all attachments to those motions, are sealed. We find good cause to seal those motions based on the personal financial information contained in the motions and the lack of any substantial interest by the public in access to such personal information. MCR 8.119(I)(1)-(2). There is no less restrictive means to adequately and effectively protect appellant's interest in the privacy of that information. MCR 7.211(C)(9)(e). However, the motion is DENIED TO THE EXTENT that it seeks to seal this Court's March 23, 2022 order initially denying appellant's motion to waive fees and this Court's April 25, 2022 order granting the motion to waive fees on reconsideration because we may not seal a court order. MCR 8.119(I)(6). We note that neither of those orders includes any specific personal information.
The Clerk shall disclose or provide copies of any order or opinion entered in this appeal, MCR 8.119(I)(6), but sealed pleadings or other contents of the file shall not be disclosed or made available for public viewing. The case docket shall not be blocked on the Court's website.
The Clerk is directed to forward a copy of this order to the Clerk of the Supreme Court and to the State Court Administrative Office. MCR 8.119(I)(7).
