By order of November 30, 1999, the application for leave to appeal from the January 26, 1999 decision of the Court of Appeals was held in abeyance pending the decision in Connaway v Welded Construction Co (Docket No. 113799). On order of the Court, that case having been decided sub nom Mudel v Great Atlantic Pacific Tea Co, 462 Mich. 691 (2000), on July 25, 2000, the application is again considered, and and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would remand the case to the Court of Appeals as on leave granted.
