Judgment and order reversed on the facts and new trial granted, with costs to the appellant to abide the event. Memorandum: In view of the law of the case as indicated by the allegations of the complaint and the charge of the trial court we reach the conclusion that the finding of negligence on the part of the appellant is against the weight of the evidence. All concur.
