ORDER

Sarah Beth Landau, Judge.

On July 30, 2024, the Court issued an order abating this appeal (01-23-00725-CV) and original proceeding on petition for writ of mandamus (01-23-00843-CV) and referring the parties to mediation. On October 18, 2024, the mediator reported that the parties attended mediation but were unable to reach an agreement as to any aspects of the appeal or original proceeding. On October 28, 2024, the parties filed an agreed motion to reinstate the appeal and original proceeding. The request to reinstate is granted. The abatement is lifted, and the appeal and original proceeding are reinstated on the Court's active docket. Douglas Lerner's appellee's brief in the appeal and his response to the mandamus petition in the original proceeding are both due by December 5, 2024.

It is so ORDERED.
