Judgment and order reversed on the law and facts and new trial granted, with costs to the appellant to abide the event, on the ground that the plaintiff has failed to meet the burden of proof. Van Kirk, P.J., Hinman, Whitmyer and Hill, JJ., concur; Davis, J., dissents and votes for affirmance.
