MEMORANDUM OF DECISION AND ORDER


This matter is before the Court for a ruling on damages, attorney's fees, and costs and for entry of final judgment.

On September 28, 2001, this Court found that the Plaintiff, Anthony S. Lenzo, is entitled to money damages and pre-judgment interest in this lawsuit under the Age Discrimination in Employment Act, 29 U.S.C. § 623. The Court directed the Plaintiff to file his calculations of damages and pre-judgment interest pursuant to the Court's directions within fourteen (14) days of the entry of that Order and granted the Plaintiff leave to file a request for attorney fees and costs within fourteen (14) days of the entry of that Order. The Court also directed the Defendant to file any objections to the Plaintiff's calculations within fourteen (14) days of the Plaintiff's filing of his calculations and granted the Defendant leave to file a response within fourteen (14) days of the Plaintiff's filing of his request for fees and costs. The Court directed the Plaintiff to file any reply within seven (7) days of the Defendant's filing of its objections and granted the Plaintiff leave to file a reply within seven (7) days of the Defendant's filing of its response.

On October 9, 2001, the Plaintiff filed his Verified Calculation of Damages [DE 63] and Verified Motion for Attorney Fees and Costs [DE 62]. In his Verified Calculation of Damages, the Plaintiff calculated damages and pre-judgment interest, representing to the Court that he is entitled to entry of judgment in his favor in the total sum of One Hundred One Thousand Eight Hundred Forty-One and 48/100 Dollars ($101,841.48) as of September 28, 2001. In his Verified Motion for Attorney Fees and Costs, the Plaintiff requests Thirty-Four Thousand Six Hundred Two Dollars ($34,682.00) in attorney's fees and Seven Hundred Six and 82/100 Dollars ($706.82) in costs. As of the date of this Order, the Defendant has not filed any objections to the Plaintiff's calculations of damages or a response regarding the Plaintiff's request for attorney's fees and costs. The time for such objections and response having now passed, the Court finds this matter ripe for ruling. On October 22, 2001, the Plaintiff's costs were taxed against the Defendant in the amount of Seven Hundred Six and 82/100 Dollars ($706.82).

CONCLUSION

For the foregoing reasons, judgment is hereby ENTERED in favor of the Plaintiff, Anthony S. Lenzo, in the total sum of One Hundred One Thousand Eight Hundred Forty-One and 48/100 Dollars ($101,841.48). The Plaintiff's Verified Motion for Attorney Fees [DE 62] is GRANTED, and the Plaintiff is AWARDED attorney's fees in the total sum of Thirty-Four Thousand Six Hundred Two Dollars ($34,682.00). The Clerk is ORDERED to enter final judgment in favor of the Plaintiff, Anthony S. Lenzo, and against the Defendant, School City of East Chicago.
