On Remand from the Alabama Supreme Court


On the authority of Ex parte Lemus, 802 So.2d 1073 (Ala. 2001), we reverse the judgment of the circuit court and remand the cause for further proceedings consistent with that opinion.

REVERSED AND REMANDED.
