MEMORANDUM OPINION


By letter dated April 21, 2010, the Court notified appellant that the Dallas County District Clerk had informed us appellant has not paid for the clerk's record. We directed appellant to provide the Court, within ten days, with written verification either that he made payment arrangements or is entitled to proceed without payment of costs for the clerk's record. We warned that failure to comply would result in dismissal of the appeal. To date, appellant has neither provided verification of payment nor otherwise communicated with the Court regarding the appeal. And, on May 5, 2010, we received a second letter from the District Clerk stating appellant has not paid for the record. Accordingly, we dismiss the appeal. See Tex. R. App. P. 37.3(b), 42.3.
