An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about June 03, 2021, which reaffirmed Supreme Court's May 13, 2021 directive requiring defendant to disclose certain documents and information, including the intervenor-appellant's identity, by a date certain, and declined to sign defendant's order to show cause, And nonparty intervenor-appellant having moved for a stay of enforcement of the June 03, 2021 order pending the hearing and determination of the appeal taken therefrom, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is deemed an application for CPLR5704(a) relief and, as such, is denied, and the interim relief granted by a Justice of this Court, in an order dated June 15, 2021, is hereby vacated.
