This case was called and recalled from the calendar of the Court's Denver, Colorado trial session on January 9, 2023, for hearing on respondent's Motion to Dismiss for Failure to Properly Prosecute, filed December 8, 2022. Both parties appeared and were heard. After due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that jurisdiction is retained by the undersigned. It is further ORDERED that the Court's Order to Show Cause, dated December 15, 2022, is discharged. It is further

ORDERED that, on or before February 8, 2023, the parties shall submit proposed stipulated decision documents or file status reports regarding the then-present status of this case.

The parties are reminded that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed December 8, 2022, remains pending.
