The defendant promised to the plaintiff's attorney ex parte quaerentis (anglice), on behalf of the plaintiff that he should pay him, etc., in consideration, etc. The plaintiff brought an action on the case, and declared specially as here, but not generally of a promise made to himself. It was adjudged well. It was said it would be well either way.
