Lee v. State

District Court of Appeal of Florida, Second District
Jul 9, 1999
736 So. 2d 153 (Fla. Dist. Ct. App. 1999)

Opinion

No. 98-00911.

Opinion filed July 9, 1999.

Appeal from the Circuit Court for Polk County; Susan W. Roberts, Judge.

James Marion Moorman, Public Defender, and Joanna B. Conner, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Erica M. Raffel, Assistant Attorney General, Tampa, for Appellee.

Deborah Lee contends, and the State agrees, that the trial court erroneously denied her motion to withdraw her previously entered no contest pleas. Accordingly, we reverse and remand with directions to the trial court to grant Lee's motion to withdraw her pleas.

Reversed and remanded for further proceedings.

THREADGILL, A.C.J., and FULMER, J., Concur.
