Appellant's brief was originally due to be filed on September 9, 2024. On September 23, 2024, appellant filed a motion for extension of time, requesting a sixty-day extension. In the motion, appellant's attorney stated, among other things, that volumes 1 and 3 of the reporter's record had yet to be placed in the attorney portal. We granted appellant's motion in part and extended the deadline to file appellant's brief to October 9, 2024.
To date, appellant's brief has not been filed. Therefore, appellant's attorney is ORDERED to respond to this court in writing by November 8, 2024. The response should state a reasonable explanation for failing to timely file appellant's brief and demonstrate the steps being taken to remedy the deficiency. If appellant's attorney requires assistance navigating the attorney portal, he is instructed to contact the Chief Deputy Clerk at 210-335-2635 during normal business hours; a deputy clerk of this court has reviewed the attorney portal and has confirmed that volumes 1 and 3 of the reporter's record are available. If appellant's attorney fails to file an adequate response by November 8, 2024, this appeal will be abated to the trial court for an abandonment hearing, and the trial court will be asked to consider whether sanctions are appropriate. See Tex. R App. P. 38.8(b)(2).
