DECISION & ORDER ON MOTION

Motion by appellant to continue the stay of the execution of a warrant of eviction pending the determination of an appeal from a judgment of the City Court of Long Beach, Nassau County, entered July 12, 2022, and for an extension of time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to continue the stay is granted on condition that appellant perfect the appeal on or before June 16, 2023; and it is further, ORDERED that the branch of the motion seeking an extension of time to perfect the appeal is likewise granted; and it is further, ORDERED that, in the event the appeal is not perfected on or before June 16, 2023, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay, on three days' notice, and may serve such application in person.
