On August 14, 20 02, the Court received the motion by defendant Peregrine Systems, Inc. to dismiss this action or, in the alternative, for an order transferring this action pursuant to 28 U.S.C. § 1404(a), to the United States District Court for the Southern District of California for consolidation with earlier-filed litigation concerning substantially the same facts and issues of law. On August 16, 2002, plaintiff filed opposition to the motion; on August 28th defendant Arthur Anderson joined the motion. By letter to the Court dated December 2, 2002, plaintiff has withdrawn his opposition to the motion to transfer this action. The opposition having been withdrawn, defendants' motion to transfer this action is granted and it is hereby

ORDERED, that this action shall and hereby is transferred to the United States District Court for the Southern District of California.
