On Appeal from the 142nd District Court Midland County, Texas Trial Court Cause No. CR52044
Panel consists of: Bailey, C.J., Trotter, J., and Williams, J.
ORDER
PER CURIAM
This appeal stems from a capital murder case wherein the State sought the death penalty. Following numerous pretrial hearings, the trial, beginning with jury selection, was conducted between April 2, 2024, and July 18, 2024. The jury found Appellant guilty of capital murder and assessed his punishment at life imprisonment. This appeal followed.
The court reporter, Melissa D. Crooks, has informed this court that the reporter's record will be approximately 11,000 pages and include eighty volumes exclusive of the exhibits. Crooks states that she estimates that the exhibits will add more than 3,000 pages to the reporter's record. Given the time that she anticipates that it will take to complete the record and the numerous proceedings that require transcription in this case, we abate this appeal to allow Crooks sufficient time to prepare and compile the reporter's record. See Tex. R. App. P. 35.3(c) ("The appellate court may enter any order necessary to ensure the timely filing of the appellate record."). Accordingly, this appeal is abated until April 15, 2025, or when the complete appellate record is filed in this court, whichever is earlier.
The appeal is abated until April 15, 2025, or when the complete appellate record is filed in this court, at which time the appeal will be reinstated. The reporter's record is now due for filing on or before April 15, 2025.
