Opinion

No. 10-04-00261-CR

Opinion Delivered and Filed May 4, 2005. DO NOT PUBLISH.

Appeal from the Crim. Dist. Ct., Jefferson County, Texas, Trial Court # 80685. Appeal dismissed Motion to withdraw as counsel denied.

Before Chief Justice GRAY, Justice VANCE, and Justice REYNA.

MEMORANDUM OPINION

David Patrick LeBlanc and his counsel each filed a motion to withdraw LeBlanc's notice of appeal. LeBlanc personally signed each motion. This opinion disposes of both motions. We have not issued a decision in this appeal. The Clerk of this Court has sent a duplicate copy of each motion to withdraw to the trial court clerk. The appeal is dismissed. See TEX. R. APP. P. 42.2(a). LeBlanc's counsel also filed an Anders brief and a motion to withdraw as LeBlanc's counsel. We deny appointed counsel's motion to withdraw. See Sowels v. State, 45 S.W.3d 690, 692 (Tex.App.-Waco 2001, no pet.); Enriquez v. State, 999 S.W.2d 906, 908 (Tex.App.-Waco 1999, order). In light of our disposition of this appeal, the Anders brief is moot.

Anders v. California, 386 U.S. 738, 87 S. Ct. 1396, 18 L.Ed. 2d 493 (1967).
