Appeal Dismissed — Jurisdiction — Sentence.

In absence of a sentence, Court of Criminal Appeals is without jurisdiction of an attempted appeal.

Appeal from District Court of Wichita County. Hon. Irvin J. Voel, Judge.

Appeal from conviction for driving an automobile on a public highway while under the influence of intoxicating liquor; penalty, fine of $50.00 and confinement in jail for five days.

Appeal dismissed.

The opinion states the case.

The offense is driving an automobile on a public highway while under the influence of intoxicating liquor; the punishment, a fine of $50.00 and confinement in jail for five days.

It does not appear that appellant was sentenced. In the absence of a sentence this court is without jurisdiction.

The appeal is dismissed.
