MEMORANDUM OPINION


On October 12, 2005, the parties filed a joint motion asserting that they have settled all claims in this case and moved to vacate the trial court's judgment and dismiss the case. Accordingly, the Court GRANTS the motion. We VACATE the trial court's judgment without regard to the merits and DISMISS the case. Tex.R.App.P. 43.2(e). We ORDER the parties to bear their own costs of appeal.
